Responsibility: By booking a photo tour / workshop, participants certify that they have carefully read the dates, schedule of activities and the “Terms & Conditions” for the Photo Tour (hereinafter referred to as the “Tour”) and are aware that the Tour involves the risk of personal injury, death or loss (damage) to property. In consideration of the benefits derived by the Tour, participants voluntarily recognize and accept all risks thereof. Participants agree on behalf of themselves, their dependents, heirs, executors, and assigns, to release and hold harmless Nomad Photo Club, its employees, subsidiaries, affiliates, officers, directors, successors, representatives, assigns and its designated tour agencies (hereinafter referred to as the “ Tour Partners”) from any and all claims, including but not limited to liability for delays, monetary damages, illness, injuries, death, or for the loss of or damage to property resulting directly or indirectly from any occurrences or conditions. Participants agree to abide by the conditions set forth under the “Terms & Conditions” and other sections as stated herein or elsewhere published. Participants affirm that they are covered by medical insurance, which is valid overseas and affirm that they have not relied on any additional oral or written representation of the Tour Partners for executing this release. Participants further acknowledge receipt of this release and understand and accept its terms and conditions. Any questions participants had concerning this release have been answered fully.
The Tour Partners organize, promote, and sell the Tour along with services they purchase from other suppliers. The suppliers are independent contractors and are not agents or employees of the Tour Partners. They supply services that include, but are not limited to, transportation, accommodations, meals, and excursions using local guides. While we endeavour to make travel arrangements with reputable suppliers, the Tour Partners are not responsible for the wilful or negligent acts and/or omissions of such suppliers, their employees, agents, servants, or representatives, including, without limitation, their failure or inadequate delivery of services. All travel and arrangements are subject to the terms and conditions specified by the suppliers, air carriers and/or applicable governing laws. The Tour Partners and the suppliers providing transportation or any service can accept no responsibility for losses or additional expenses due to, but not limited to, delay, inconvenience, changes to or cancellation of itinerary, sickness, weather, strike, war, quarantine, terrorism, defects in vehicles, breakdown in equipment, animals including transportation by animals, hiking, and any act, omission, negligence or other causes beyond their control. All such losses or expenses will be borne by the passenger, as the Tour rates provide for arrangements only for the time stated. The Tour Partners are not responsible for expenses incurred by Tour members in preparing for the Tour (i.e.: air tickets, visa/passport fees, equipment, medical expenses, individual transfers, etc.).
Assumption of Risk: Participants are voluntarily participating in the Tour with knowledge that it involves some inherent risks and danger including, but not limited to, forces of nature, terrorism, civil unrest, strikes, wild animals (including animals used for transportation), all activities including hiking over rough terrain, cancellation or changes in itinerary, theft, negligent action of others or their agencies, or means of conveyance or accommodation which may not be operated nor maintained to standards common in Western countries. This includes health-related issues, and I am aware that medical services or facilities may not be readily available or accessible during all or part of the Tour. This includes emergency medical care, presence of physicians, and adequate medication. On expeditions of this type it is not possible to accommodate persons with severe health problems, physical disabilities or mental illness. It is the passenger’s responsibility to judge the appropriateness of the travel activities to their own physical and mental capabilities. By forwarding the deposit, the tour member certifies they agree with these terms and conditions and that they do not have any mental, physical or other condition or disability that would create hazard for them or other participants. The Tour Partners and their suppliers take no responsibility for special arrangements or problems incurred by Tour Members unable to participate in the Tour or planned activities. The right is reserved to decline any person as a member of the Tour, or to require any participant to withdraw from the Tour at any time.
Fitness and Health: Anyone who is reasonably fit should be able to participate in most activities on the Tour. It’s possible to experience general fatigue due to long flights and changes in time zones. You will need to be sufficiently agile to climb in and out of the transport vehicle and be able to carry and manage your own photographic equipment and luggage. We will hike trails and paths ranging from easy to moderate throughout the Tour.
If you have any special needs or any physical condition that you feel might prevent you from fully participating, please make us aware when registering for the Tour or email us in advance with your questions or concerns.
Please be aware that medical services and facilities might not be readily available during all or part of the Tour. This could include emergency medical care, presence of physicians, or adequate medication. Please notify us in advance of any allergies, physical / mental conditions or medications you’re currently taking that may affect your health.
Changes in Services: Rates are based on tariffs, Euro / US dollar exchange rates and supplier fees in effect at the time of publishing. We reserve the right to alter our prices. Please note that if the Tour Partners cancel a tour extension, you are subject to the cancellation penalty for the main tour should you subsequently decide to cancel your main tour. Individual transfers for those traveling independently are not included unless otherwise stated. If the group falls below the minimum requirement of 6 paying participants to 3-5, the expedition is subject to cancellation. Accommodations are based on double occupancy (two people sharing a room). Requests for single occupancy are assigned on a first-come, first-served basis, when available and subject to a supplemental fee at the rate stated on the individual tour website page.
The Tour Partners reserve the right to cancel or make changes to the published itinerary, whenever, in its judgment, conditions warrant, without consulting the Tour members. Tour members have no right to any refund or other considerations in the event of these itinerary changes. The Tour Partners reserve the right to cancel any Tour before departure, in which case a full refund of all amounts paid to the Tour Partners will be made. If changes are made, tour leaders will plan each day considering the interests of the group and the weather at hand. Be assured that we will make substitutions that are similar in quality and interest when possible.
Code of Conduct: Participants are expected to conduct themselves in a manner that is respectful to the group and other participants. Any use of illegal drugs or substances, committing or participating in any criminal or illegal activity and violence of any sort will not be tolerated and will result in the tour member immediate removal from the Tour, without refund and at the participant’s expense. Tour leaders are authorized, and hereby reserve the right, to remove or exclude participants from the Tour, or any portion thereof, for actions they deem as inappropriate or disruptive to the group or Tour.
Airfare: Airfare is NOT included in the Tour Rates provided. Before booking your airfare, please contact Nomad Photo Club for arrival and departure time specific requirements. Nomad Photo Club can accept no responsibility for losses or additional expenses on airfare due to Tour cancellation or alteration. We suggest booking a refundable fare or purchasing the optional insurance in case the Tour must cancelled, postponed or altered.
Included in Tour Costs: Group ground transportation for the Tour activities. Accommodations, based on double occupancy (two people sharing a room) .Requests for single occupancy are assigned on a first-come, first-served basis and subject to a supplemental fee at the rate stated on the individual tour website page. Services of driver, English speaking guide and photographic leaders throughout the Tour. Meals as listed in the on the individual Tour website page. Tickets, entrance fees, all tours and guides as listed on the individual Tour website page.
NOT Included in Tour Costs: Domestic or International airfare to and from the Tour beginning & ending locations; airfare tax; airport departure tax (if applicable); airport departure transfers; additional transfers or accommodations that may be required by those not traveling with the group; excess baggage charges; meals / snacks not included in the Tour as indicated on the individual Tour website page; side activities taken on your own; passport / visa expenses; individual medical or travel insurance costs; any expenses of a personal nature, such as room service, laundry, drinks outside of meals & alcoholic beverages; medical expenses; photographic equipment; any activities not specified in the Tour itinerary or that are listed as optional, or any items not listed in what is included on the individual Tour information page on our website; possible fuel surcharges; exchange rate surcharges; modest gratuities to the guides and drivers are customary.
Single / Shared Accommodations: A limited number of single rooms/cabins are available at an extra cost on a first-come, first-served basis.
Payments, Cancellations, and Refunds: A deposit per participant is required at the time of registration to reserve your spot. Required deposit amounts will be listed on the individual Tour page on our website. Payment in full is required when registration is completed less than 60 days before the departure date. Space is subject to cancellation by the Tour Partners if payments are not received when due. If a participant would like to cancel they must send an email notification. Please note your cancellation is not considered official until you have received a return email confirmation acknowledging your cancellation. At the time we receive your cancellation notification, the following per person charges will be applied.
91 days or more before departure: 350 USD cancellation fee, plus any additional costs incurred, as well as any fees that are charged by the suppliers providing the services included in the Tour. If your spot is filled by another participant, we’ll refund your deposit minus payment processing fees and 175 USD administrative fee.
61-90 days before departure: 575 USD cancellation fee, plus any additional costs incurred, as well as fees, if applicable, that are charged by the suppliers providing the services included in the Tour. If your spot is filled by another participant, we will refund your deposit minus payment processing fees and 175 USD administrative fee.
60 days or less before departure or any time after departure: NO REFUNDS WILL BE GIVEN and your deposit will be forfeited.
Payments in Full are required no later than 60 Days prior to departure. If full and final payment is not received by this date you will be notified via email two times requesting final payment. After that, we will consider your failure to make payment a cancellation and your spot in the Tour will be forfeit and offered to those participants on the waiting list and your deposit will not be returned.
Travel Insurance: Each participant hereby confirms that they understand and agree to purchase the required insurance listed below, that is valid internationally, and that they will be required to provide proof prior to departure for the Tour and in order to participate.
Suggested Additional Coverage:
We strongly urge you to evaluate your risk and to take out travel insurance that covers the full value of the Tour and personal effects in the case of Tour cancellation, loss or theft of baggage, and emergency evacuation. The Tour Partners, their owners, agents and subsidiaries will not be held responsible for these expenses. It is vital for you to realize that if you experience a delay or find it necessary to cancel or cut short the Tour for any reason, you will lose part or the entire sum of the amount paid (see the section “Deposits, Payments, Cancellations and Refunds” in the terms and conditions above).
Travel insurance helps to minimize the risk of monetary losses you would incur in the event of a delay of your departure due to weather, airline strike, missed connection, etc …, your inability to travel for reasons such as illness, injury, unforeseen financial complications and other personal circumstances, or if you were required to cut the Tour short for medical or any other reasons.
There are restrictions and limitations on any insurance program. For this reason, we recommend that you read carefully the fine print of your insurance policy.
Model Release: Nomad Photo Club and its designated Tour Partners and Tour leaders reserve the right to take photographs and/or videos during the operation of any Tour or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By making a reservation on a Nomad Photo Club tour, the participant agrees to allow his/her likeness to be used by Nomad Photo Club and the tour operator without compensation to the participant. If the participant prefers that his/her likeness not be used, he/she must notify us in writing prior to departure of the Tour.
Photo Release: Copyright in all photographs, video, and related materials (herein referred to as “Tour Materials”) created by the participant shall belong to the participant upon creation. The participant grants to the Tour Partners their owners, agents and subsidiaries, a non-exclusive, worldwide, irrevocable license to use any Tour Materials voluntarily provided to the Tour Collaborators in any media for the following purposes: editorial use, promotion of this editorial use, advertising and promotion of Photo Tours offered by the Tour Partners or promotion of Photo Tours led by Tour Leaders representing the Tour Partners.
Food and Drink: Lunches will be informal, eaten in places convenient to the shooting areas. This will allow maximum flexibility.
Participants hereby acknowledge that they have read, understand and agree to, and will abide by, all the Terms and Conditions of participation in the Tour as set out above.
Participants confirm that they have reviewed & agree to the dates and costs of the Tour and that they understand that flights are not included in the cost.
Final Payment in FULL is required within 60 days before departure for the Tour or participants risk losing the deposit and having their spot forfeited to a participant on the waiting list. You can e-mail us if you have any questions regarding making final payment.
Terms and Conditions of artist’s proof, limited edition and open print sales
0.1 These terms and conditions apply to the purchase of all forms of photographic print ( herein “limited edition print”, “print”) across all editions – including “open edition”, “limited edition” and “artist’s proof” – regardless of payment amount
0.2 The terms and conditions below form part of the contract between us (“our”, “Nomad Photo Club”, “we”) and you (“buyer”, “customer”, “you”) and are the basis on which any disagreement will be considered.
0.3 By purchasing a limited edition print, you are acknowledging and agreeing to the terms and conditions set about below.
Definition of Editions
1.1 “Artist’s Proof” – A photographic print, limited to a maximum edition run of 5 worldwide across all sizes. Each artist’s proof print is hand signed and marked with the edition type and number by the photographer, affixed with a unique serial numbered hologram set, provided with its certificate of authenticity which includes a matching hologram and registered with Hahnemuehle’s Fine Art Registry database for future traceability and valuation.
1.2 “Limited Edition” – A photographic fine art print, limited to a maximum edition run of 15, 30 or 100 worldwide across all sizes. Each limited edition print is inspected, hand signed and marked with the edition type and number by the photographer.
1.3 “Open Edition” or “Poster Edition” – A reproduction print, unlimited in number worldwide, produced as part of a larger edition run with no signature or certification.
2.1 By purchasing a print, you are confirming that you have read the associated print description, and selected the appropriate edition type and size as required by you.
3.1 All orders must be submitted via this website (“https://www.nomadphotoclub.com”, herein “website”) in accordance with the instructions set out on each step and page of the checkout process.
3.2 You are responsible for ensuring the completeness and accuracy of your order details and Nomad Photo Club will not be liable for any failure by you to provide complete and accurate information in your order.
3.3 All print orders are for custom, made to measure, on-demand photographic prints.
3.4 Orders may only be deemed to have been accepted by us upon your receipt of our order confirmation in writing (which may be by e-mail), along with relevant order reference number.
3.5 We reserve the right to:
3.5.1. Reject any order submitted by you for any reason. Note, in particular, that orders by customers in certain countries may be held for inspection and checks for fraudulent payment methods prior to acceptance by us.
3.5.2. Cancel any order before delivery of the relevant print in the event any payment of the full order value fails.
3.6. Without limitation to any provisions relating to Limitation of Liability, we will not be liable or otherwise responsible for any loss or damage caused to the you by cancellation of an order by us.
4.1 Standard production and delivery times are 6-8 weeks from the point of order, although we will always endeavour to reduce this when possible.
4.2 Your order will be fulfilled by the estimated delivery date set out in the Confirmation, unless there is an event outside our control. If we are unable to meet the estimated delivery date because of an event outside our control, we will contact you with a revised estimated delivery date.
4.3 Delivery will be completed when we deliver the print(s) to the shipping address you gave us when ordering.
4.4 If no one is available at the shipping address to take delivery. We will arrange with our carrier to redeliver the item. Otherwise it will be up to you to collect from the depot described on the delivery notice.
4.5 The print(s) will be your responsibility from the completion of delivery.
4.6 You own the print(s) once we have received payment in full, including all applicable delivery charges.
4.7 You are responsible for inspecting the external packaging of the prints, on receipt, and marking any noticeable damage on the delivery confirmation receipt as required by the courier.
4.8 Any items which are significantly damaged must be rejected by you, and returned to the courier at the point of attempted delivery. You must immediately inform us of any delivery rejection in order that we can contact the courier to resolve the situation.
4.9 Failure to inform us of any damage to the print(s) within 48 hours of the courier’s delivery receipt confirms your acceptance of your order in good condition.
Returns & Refunds
5.1 All print orders are for custom, made to measure, on-demand photographic prints.
5.2 Any order which has been damaged prior to delivery, where you have informed us within 48 hours of the delivery attempt (subject to the provisions in clause 4 – “Delivery”), will be replaced by us free of charge with a duplicate copy of the same print as ordered.
5.2 All orders that are delivered and confirmed as undamaged, or where we have not been informed of any courier damage within 48 hours of delivery, are deemed to have been accepted by you in good condition and will no longer be replaced by us for free on return of the damaged item for disposal.
5.3 Any damage caused after successful delivery is the responsibility of the customer, and any replacements will be provided subject to payment of the current print price on the website.
5.4 Damage caused during self-organised framing or mounting is the responsibility of the customer, and no refund for prints that have been spoiled in this way.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your replacement or refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 30 days.
Customs, Excise Duties & Import Taxes
6.1 All prints are produced and shipped from Montreal, Canada.
6.2 As a responsible international seller, we are legally bound to provide information the relevant import and export authorities when shipping prints to countries outside of Canada.
6.3 We will ensure, where appropriate, that the value stated for the purposes of import and export to the country of delivery is accurate and correct, reflecting the actual material replacement cost of the order.
6.4 The payment of any import customs charges, duties and taxes, whether local or international, are the responsibility of the customer.
Events Outside of Our Control
7.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this contract that is caused by an event outside our control.
7.2 An event outside of our control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
7.3 If an event outside of our control takes place that affects the performance of our obligations under this contract:
7.3.1 we will contact you as soon as reasonably possible to notify you; and
7.3.2 our obligations under this contract will be suspended and the time for performance of our obligations will be extended for the duration of the event outside of our control. Where the event outside of our control affects our delivery of your print(s) to you, we will arrange a new delivery date with you after the event outside of our control is over.
Print Guarantee & Warranty
8.1 All prints are provided with a guarantee against colour degradation and fading, limited in time to the lifetime of the original purchaser.
8.2 This guarantee means that we will provide you with replacement print of the same size, specification and image where the visible colour content has deteriorated below 60% of its original saturation and density, subject to the following conditions:
8.2.1 The print(s) must have been stored and displayed out of any form of direct sunlight during its entire lifetime.
8.2.2 The print(s) must have been protected behind a material capable of removing at least 95% of all Ultra-Violet wavelengths of light during its entire lifetime.
8.2.3 The print(s) have not been subjected to any temperature below 0°C or above 30°C during its entire lifetime.
8.2.4 The print(s) have not been touched directly by any organic object or being, nor exposed to any form of liquid or potentially damaging substance during its entire lifetime.
8.3 To invoke the guaranteed replacement warranty, a claim should be sent by you to us in writing, detailing the specifics of the damage caused by fading, including photographs of the print(s) in question.
8.4 On receipt of a valid claim, we may require further independent specialist opinion to confirm the likely cause of damage, which will be provided at our cost.
8.5 Following confirmation by us (subject to any specialist opinion), a replacement print will be provided to you free of charge.
8.6 On receipt of the replacement, the original print must be either returned to us or destroyed (at our discretion) with proof of sending or destruction being provided by you within 5 working days.
8.7 This guarantee does not apply where the print has been damaged due to obvious wear and tear during the period of possession by the customer.
Price of Prints & Delivery
9.1 The prices of the prints will be as quoted on our site from time to time. We take all reasonable care to ensure that these prices are correct at the time when the relevant information was entered onto the system. However if we discover an error in the price of print(s) you ordered, please see clause 9.4 for what happens in this event.
9.2 Prices for our prints may change from time to time, but changes will not affect any order which we have confirmed with a dispatch confirmation.
9.3 The price of a Product does not include delivery charges. Our delivery charges are as quoted on our site from time to time. To check relevant delivery charges, please refer to the “Delivery” line at checkout, or in the case of bespoke images this can be found on your written quotation.
9.4 It is always possible that, despite our reasonable efforts, some of the prints on our site may be incorrectly priced. If we discover an error in the price of a print you have ordered we will inform you of this error and we will give you the option of continuing to purchase the print at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the prints to you at the incorrect (lower) price.
10.1 Unless stated on your order confirmation and receipt, all prints are delivered as “loose photographs”, in a rolled tube with protective packaging.
10.2 Where we have offered framing or mounting, and this option is included on your order confirmation, the print(s) will arrive fully assembled in your chosen format, in a protective shipping container or package.
10.3 You hold sole responsibility for framing or mounting your print(s), including any damage caused during this process as detailed in section 5.
Copyright and Ownership
11.1 By purchasing a print from us, you understand that you own a copy of an original photograph as captured by the original creator.
11.2 At no point do you, or will you, own the copyright of any image purchased from us as a print.
11.3 Prints may not be reproduced, copied, shared electronically or used for any commercial purposes without our prior, express, permission and any applicable fee (as determined by Nomad Photo Club) being paid.
11.4 It is illegal to produce copies of any work which is copyrighted by us, and we reserve the right to request legal assistance to enforce any applicable laws should any breach of copyright be discovered.
12.1 You can pay for prints using our chosen secure credit card gateway online.
12.2 Payment for the prints and all applicable delivery charges must be made in advance.
12.3 Upon our sending of your order confirmation by email, this contract is then deemed to be in force and all applicable clauses and terms apply.
12.4 Once delivery of your order has been signed for as accepted, your order and payment are considered complete.
Our Right to Vary These Terms
13.1 We may revise these Terms from time to time.
13.2 Every time you order prints from us, the Terms in force at that time will apply to the Contract between you and us.
13.3 The Terms applicable to your contract will be determined as those published and active on the date your order was placed.
Privacy and Data Protection
14.1 We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.
14.2 We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organisation, other than as necessary to fulfill your request, e.g. to ship an order.
14.4 Your Access to and Control Over Information

14.5.3 While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing, shipping or service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.
Jurisdiction and Disputes
15.1 These terms are governed by the laws of Quebec.
15.2 We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms.
15.3 You may only transfer your rights or your obligations under these Terms to another person if we agree in writing. However if you have purchased a print as a gift, you may transfer the benefit of the our guarantee in clause 8 to the recipient of the gift without needing to ask our consent.
15.4 This contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts or otherwise. However, the recipient of your gift of a print will have the benefit of our guarantee at clause 8, but we and you will not need their consent to cancel or make any changes to these Terms.
15.5 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
15.6 If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
15.7 This Contract for the purchase of prints through our site and any dispute or claim arising out of or in connection with it will be governed by the laws of Quebec.
15.8 We will not file a copy of the Contract between us.
